Town of Danville Conflict of Interest Policy Authority and Purpose: The Selectboard of the Town of Danville hereby adopts the following policy, for all elected and appointed officials and employees of the Town of Danville, under the authority granted in 24 V.S.A. Chapter 59 and 24 V.S.A. sec 2291(20). The purpose of this policy is to insure that the business of this Town will be conducted in such a manner that no public official or employee of the Town will gain a personal or pecuniary advantage from his or her work for the Town so that the public trust in municipal officials will be preserved. Conflict of interest means a direct personal or pecuniary interest of a public official or employee, his or her spouse, household member, near relative, business associate, employer or employee, in the outcome of a case, proceeding, application, or any other matter, pending before the official or before the public body in which he or she holds office or employment. A town official or employee who has reason to believe that he or she has or may have a conflict of interest shall state the nature of the conflict as soon as possible and shall thereupon disqualify him or herself from further participation. If an official does not declare a conflict of interest the remaining officials of that body shall have the authority to inquire of the official about a possible conflict of interest and to suggest or recommend that the member disqualify him or herself from the matter. If the official refuses to disqualify him or herself, the remaining officials of that body may take a vote as to whether the official be allowed to participate. If there is a specific written complaint of a conflict of interest of a Town official or employee, the Selectboard shall consider the factual basis of the complaint, and conduct an investigation in accordance with this policy and arrive at a decision. If it is determined that a conflict of interest exists, any vote or contract entered into by the official or employee may be negated. If any section of this policy is held to be invalid, such finding shall not invalidate any other part of this policy. This policy shall become effective May 15, 2003.
