Selectboard Hearing Minutes

Zoning Bylaws

                      November 5th, 2009

Michael K Walsh called the hearing to order at 7:05 pm. Selectboard present were, Michael K Walsh, Doug Pastula, Steve Larrabee, and Denise Briggs. Also present were Wendy Somers, Gail Devereaux, Linda Leone, Kevin Gadapee, Merton Leonard, Jeff Frampton, Kim Prior, Nancy, Michael Smith, James Ashley, Mike Boudreau, Tim Ide, Toby Balivet, Kellie Merrill, visitors Mary and Hollis Prior, Barb and Gary Fontaine, Ken Linsley, reporter Sally Anderson.

Michael turned the meeting over to Jeff Frampton, Planning Commission Chair. Jeff briefly outlined the steps getting to this version of the proposed bylaws, that included; revising the town plan to current standards that would be used for a planning guide to zoning; obtain a series of current maps to outline all the resources and topographical features of the town; first bylaw revision to meet the new planning chapter #117 revisions. Jeff stressed that these current bylaw changes have resulted from numerous surveys and out reach workshops held over the past two years from which the responses have been compiled to feature what Danville residents want. This resulted in new village districts with revised lot sizes and set backs, to compliment the older existing buildings while retaining the present village character. The result is these proposed bylaws are all original, not copied from anther town. The Planning Commission has been assisted by consultants Smart Growth Vermont, and grants from the Vermont Housing and Community Affairs.

 The Board and visitors discussed various parts of the bylaw revisions and the Board requested the following changes:

             Page 6, in the Village Core District, the Front setback was changed to: Equal to or between the existing principle building setbacks on adjacent lots….. from: same as setbacks of adjacent buildings…..

             Page 7 (5), modifications of Frontage Requirements added …..upon request by the applicant….

                         (7) Parking waivers added …..the same substitute parking option may not be claimed by more than one applicant ..... unless….

             Page 8 (9) added ….and ensure personal safety through adequate lighting, visibility, and pedestrian ways.

            Page 9 Historic Neighborhoods District, added front setback: Equal to or between the existing principle building setbacks on adjacent lots…..

             Page 10: (5) modifications of Frontage Requirements added …..upon request by the applicant….

            (7) Parking waivers added …..the same substitute parking option may not be claimed by more than one applicant ..... unless…….

            (9) added ….and ensure personal safety through adequate lighting, visibility, and pedestrian ways.

              Page 12: Village Residential: changed Minimum lot size to 10,000 ft and added: front setback: Equal to or between the existing principle building setbacks on adjacent lots…..

Page (13) (4) Parking waivers added …..the same substitute parking option may not be claimed by more than one applicant ..... unless….….

            (6) added ….and ensure personal safety through adequate lighting, visibility, and pedestrian ways.

             Page 15:Route 2 District: changed Minimum lot size to 20,000 ft and added: front setback: Equal to or between the existing principle building setbacks on adjacent lots…..

 Zoning Administrator Linda Leone feels that these bylaws are clear and concise with little left to interpretation. She also feels that many of the problem areas she has had with the old bylaws have been clarified. Town Attorney Toby Balivet is pleased with these new bylaws. Jeff concluded they need these bylaws approved soon as they are the basis of the remaining town villages and bylaws so they can move forward to complete the bylaws with the next grant they have with the VT H & C A.

 With no further discussion, the Board requested an updated copy of the zoning and wished to discuss their next step with a full Board. The hearing adjourned at 7:55pm.
