DraftTown of DanvilleSelectboard Minutes ofChairman, Douglas Pastula called the meeting to order at 6:10 pm. Selectboard present were, Douglas Pastula, Angelo Incerpi, Denise Briggs, Marvin Withers and Michael Walsh. Also present was: Town Clerk Wendy Somers, Kevin Gadapee, Merton Leonard, and Visitors, Kirk Fenoff, Barb and Gary Fontaine, Steve and Tammy Carrier, Bob Briggs, Jacob Roy, and Craig Vance. Marvin Withers moved to accept the minutes of the May 19th 2011 meeting, Angelo Incerpi seconded the motion as corrected to include removing an extra word, money. The motion was approved by the Board. Steve and Tammy Carrier were present to request restitution for damage caused when sewerage backed up into their house. The Larrabee's were working on installing a new sewer line to serve their property on Windswept drive. In the process they had replaced a smaller sewer line that the Carriers were connected to. During the process the Carriers sewer line became inoperable and sewerage backed up into their house. The Carriers claim their insurance will not pay for the damages, and the Larrabee's feel it is questionable as to where the fault lies. The Carriers have come to the Town to request reimbursement for their expenses as the town owns the overall sewer system. After much discussion, it was decided that Douglas would discuss the situation with Steve Larrabee, and Merton will discuss any liability that the town may have, with the town attorney, and someone will get back to the Carriers. Dan Zucker was present to discuss storm water flooding his house basement. His house is located on the corner of Peacham Road, and the School Road. He claims for whatever reason the storm drains did not allow the water to drain off so it ran into his basement. He requested someone stop by and determine if the drains are located in the best location and operating correctly. He also requested if the Town had any insurance that would pay for damage in-excess of his maximum coverage. The Board response was that the school driveway is not a town road it belongs to the school, but someone would stop by and look at the drains to determine if they may be part of the town drainage system. Merton will check with the town insurance agent to check on coverage. Bob Briggs and Jacob Roy were present to discuss Jacob's senior project, of building a new entryway onto the Fire Department's doorway. The board had approved the project but had not met Jacob. He will proceed soon, applying for the building permit to learn about the paperwork required of building projects. Bob also wanted to discuss the traffic delays in town caused by the construction work on Route #2. He believes they are much longer than allowed by the contract. Merton will check the contract delay time. The revised Town Plan as made available for the earlier town hearing, needs to be accepted in order to move on to NVDA for their approval. After a little discussion, Michael K Walsh moved to accept the Town Plan as revised May 2011, Marvin Withers seconded the motion which was approved. Merton will pass the word and a revised Plan onto NVDA. Wendy announced that they have licensed 559 dogs in town so far this year, there are a few more to left that need to be licensed . She mentioned that she has the Village Center Designation all together and ready to go to Montpelier. That the fire chief signed the fireworks permit for the Joes Pond Association, 4th of July show. Kevin’s road report noted that they have worked to get most all roads passable even if one way in areas, as the result of the May 26th / 27th and 29th rains and floods. The men have worked many - many hours over a holiday weekend and hauled many truck loads of fill, gravel and stone. Many local individuals with equipment volunteered to help-out working on areas in town that were accessible to them. FEMA has been on a quick tour of Danville, and has declared Caledonia County has met the minimum limit to qualify for disaster aid when it becomes available via a presidential declaration. He has met with VTrans several times for advice on particular road repairs, Barry Cahoon for approval on stream alterations and a federal USDA representative that may qualify some private property damage for grants or loans for repairs. After some conversation, the Board agreed to apply for the USDA assistance for individuals and private property, on a motion by Marvin Withers that was seconded by Michael K Walsh. The North Danville Road and Bruce Badger Highway are evidently classified as Major Federal Connector Highway and while not available for FEMA aid they are covered under another federal program. Kevin still working with VTrans on a replacement and/or temporary bridge by Peabody's on the Water Andric, but have not finalized the plan yet. Kevin cautioned that while the roads are passable, motorist must be aware that washouts and damage still exist on most roads to some extent. Due to the extent of the road damage and unknown amount of repair work, the paving bids requested after last meeting were cancelled. Marvin Withers moved to place a thank you notice in the paper for the road crew and foreman, and individuals that were out helping to clear the debris. Angelo Incerpi seconded the motion which was approved. The Board also wanted to go on record commending the Road crew and Forman for their long hours of work during this emergency. Craig Vance was present to discuss the damage to his property, and to request payment for the continued damaged to his property caused by the undersized culvert that runs under the Webster Hill Road near his property. He explains he has repaired damage before himself, but this time he estimates it will be $20,000 to repair his yard and driveway to keep his shop from further damage in the future, which he does not have. Merton will check to determine if any of the towns insurance will cover any private property in town, perhaps the USDA program may be an option also. Merton reported that he has been involved with documenting the flood damage required by FEMA. They require photos of before, during and after repairs filed with the damage records. At last meeting the Board was concerned with the use of the town hall for a mass distribution location for the health department. Merton discussed the short comings of the town hall for large public access, with the health department, as well as lack of facilities on the second floor. They agreed there would probably be other buildings with more desirable facilities in the area and will proceed to find another location. Merton has also filed a letter of intention with the State Transportation Department to apply for a transportation enhancement grant to repair the old railroad station. Grant facility and project, must be approved prior to the official grant application. Stone environmental has taken their first water samples from the wells they setup on the beach area. They are checking on the status of any travel of the pollution from the Dunbar property across the road. It will take a couple weeks to get the results of the testing. The state learned our concern of the 2ft culvert that exists in the Highland Avenue/Route 2/ Mountain Avenue, that will be connected to a new 4ft culvert under Route 2. The area was locally flooded as the torrent of rains washed out their work site on Route 2. The Board reviewed the budgets and signed the orders. They approved an executive session for personnel, on a motion by Denise Briggs that was seconded by Michael K Walsh, at 8:35. The Board returned from executive session at 9:00.
