                 Town of Danville – Private Snow Removal Policy

             The purpose of this policy is to protect the Town roads with in the Town of Danville and prevent snow removal practice that results in snow encroaching on the highway right-of-way, thereby creating a safety hazard for the traveling public. Vermont law, per 19 VSA # 1105, 111(b), prohibits the placing of obstructions within highways and highway rights-of-way. Violation of this law can result in a fine of up to $1000.00 as well as personal liability for the costs of repairing any damage, and for reasonable attorneys fees.

            In 1997, the Vermont legislature enacted 23 VSA # 11126a, which prohibits depositing snow onto or across highways. “No person, other than an employee in the performance of his or her official duties or other person authorized by …. the Selectboard, shall plow or otherwise deposit snow onto the traveled way, shoulder, or sidewalk of a state highway or a class 1, 2,or 3 town highway”. This law is enforceable by any law enforcement officer per 23 VASA # 1013.
